The U.S. Congress is pressing forward with its
Senate impeachment trial against former president, Donald Trump. The
trial, which is slated to last one week, centers on the January 6,
2021 riots at the Capitol building, where hundreds stormed the
building containing terrified lawmakers. Five people died during the
incident.
The Democrats in Congress are pushing for Trump to
be impeached in the Senate, stating his words were an incitement to
violence. However, issues exist with their argument, as Trump urged
the crowd to "peacefully" go forward to the Capitol building, to
protest the electoral fraud that transpired in the 2020 presidential
election that gave former U.S. vice president, Joe Biden, the
presidency.
Republicans in the Senate have stated they are not
willing to impeach Trump. The evidence is not strong enough by legal
standards and goes against the U.S. constitution. Therefore,
Democrats currently lack the votes to do so and are trying to flip
Republicans.
As stated previously on the site, Trump's attorneys,
Alan Dershowitz, stated the former president cannot be impeached, as
he has already left office. Dershowitz cited Article I Section 3
which states, "Judgment in Cases of Impeachment shall not extend
further than to removal from Office, and disqualification to hold
and enjoy any Office of honor, Trust or Profit under the United
States: but the Party convicted shall nevertheless be liable and
subject to Indictment, Trial, Judgment and Punishment, according to
Law."
