Federal Judge Barbara Lynn has corruptly dismissed a
wrongful death lawsuit filed by the family of financial analyst and
choir director, Botham Jean, who was shot and killed by trigger
happy, racist police officer, Amber Guyger, in Dallas, Texas.
Judge Lynn corruptly ruled the city of Dallas is not
liable or culpable in his murder. She has left broke and
incarcerated Guyger, who was sentenced to 10-years in prison, as the
sole defendant in the case. I completely disagree with Judge Lynn's
ruling. The City of Dallas, via the police department, is liable.
There were complaints from the public about Guyger's
questionable conduct prior to her murdering Jean in his apartment.
The police department knew of her misconduct in other matters,
indicating she was not a good police officer and was improperly
trained.

Respondeat Superior ("let the master answer") is in
reference to vicarious liability, regarding employers being held
responsible for the unlawful acts of their employees. Employers are
required to properly train employees and engage in measures to
ensure they stay on the right side of the law while performing their
jobs.
It is clear Guyger was very poorly trained and
reckless. She should have been retrained or fired. However, the
police department kept her on and she did the unthinkable in
murdering Jean in his own apartment, incredulously claiming she
thought it was her own.
The U.S. judicial system needs a massive overhaul by
Congress. Too many judges are out of control and not following the
rule of law. They are accepting massive amounts of stocks in
companies (as reported by
the Associated Press), then repeatedly ruling
in favor of large, wealthy corporations and the state whenever
possible, victims rights be damned. This misconduct is destroying
the name of the judiciary all over the watching world, who are
looking on aghast.

Judge dismisses lawsuit against Dallas over man shot by
officer in own home
December 27, 2019 / 12:08 PM - A federal judge has
ruled the city of Dallas is not liable for an off-duty police
officer fatally shooting a man in his own apartment last year. On
Monday, U.S. District Judge Barbara Lynn dismissed the city from a
civil lawsuit that the family of Botham Jean brought after he was
shot and killed by Amber Guyger.
The ruling leaves the 31-year-old former officer as
the sole defendant in the suit, which argues she used excessive
force and that better police training could have prevented Jean's
death. It makes a large financial settlement unlikely.
In her brief ruling, Lynn wrote that she was
upholding a magistrate judge's decision and dismissing the city from
the case because the suit failed "to state a claim upon which relief
can be granted." Guyger was found guilty of murder for Jean's death
and sentenced to a decade in prison in October.
