Madonna "Material Girls" Lawsuit Has Discrepancies August 21. 2010
Taylor Momsen, pictured above, is fronting a rip off fashionline by Madonna and her 12-year-old daughter, Lourdes Leon, named "Material Girls" after the 1980s song of the same name she performed. Madonna and Leon claim the clothes are trendy originals they created, inspired by the pop singer's fashions in the 1980s. However, as you can see from the photo above, the ugly clothes do not look like they come from the 1980s, neither are they similar to anything Madonna wore back then. Furthermore, how can the clothes be described as "trendy" and from the "1980s" as well. That's a massive contradiction. Madonna and co. need to look up the definition of the word "trendy." Trendy does not = retro. As mentioned on the site previously, Madonna has been sued by a clothing company, using the name "Material Girls" for their clothing line. First, the lawsuit press releases stated, the case against Madonna and her daughter, is for trademark infringement. Now the Plaintiffs are stating, the clothes are similar to their line as well. However, there are major discrepancies in both the Plaintiff and Defendant's stories. The Plaintiff's contend they have been making clothes under the "Material Girls" trademark since 1997, which Madonna has now ripped off. However, how can the clothes be similar over 13-years later, when most of the items shown in the line do not look like 1980s or 1990s fashions.Clothing styles change so often. Both Madonna and the Plaintiffs are claiming they designed a trendy line, yet there is no way clothes from the 1980s or 1990s can be classified as trendy in 2010. In 1997, people were wearing sagging, hip hop " gangsta" clothes and frumpy rocker " grunge" clothes. People are not wearing that look now in 2010. Translation, both the Plaintiffs and the Defendants need to get their stories straight. Prior to their lawsuit against Madonna, who has a long legacy of stealing, I contended online she had once again ripped off items from my Copyrighted Catalog, bastardizing a fashionable, tasteful mother/daughter fashionline I copyrighted, inspired by my mother, who made clothes 30-years ago and my idea of modern fashion. I have been designing and copyrighting several modern fashion lines for the past several years, with classic pieces, older pieces I had ideas for from 1998 and modern, cutting edge items I design each year and include in newer Library of Congress registrations. It creates a date of authenticity in the event some losers steal it. The trademark infringement in the aforementioned Material Girls v. Material Girls case is clear cut. If the psychotic biddy Madonna didn't own the copyright to the song "Material Girl" at the time in question, she has no legal standing to pursue the lecherous 1997 registration thereof, at this juncture. I wouldn't be surprised if Madonna was in on said lawsuit and did it for publicity and corrupt motive. She is addicted to publicity...and Botox. This is after all the woman that lied to the public that she had not adopted a child, spinning the publicity for all she could get out of it. Then, days later, she admitted she had indeed adopted a child, gaining the second round of desired publicity. Clothing company LA Triumph is disputing the star's rights to use ‘Material Girl’ for her trendy new range.LA Triumph filed the lawsuit at California Central District Court on Thursday, claiming that it had been manufacturing clothes under their Material Girl brand since 1997.A statement from their attorney read: "Our client and its predecessor have been continually selling similar clothes in similar retail outlets at similar price points under their Material Girl brand since at least 1997, and Madonna and her newfound company do not have the right to trade in the same space under this brand."...When the 80’s inspired clothing collection was launched at Macy’s recently, fans dressed in Madonna-inspired duds, nibbled on cupcakes and danced to the iconic pop star’s greatest hits. |
