Federal Judge Dismisses Stormy Daniels Lawsuit Against President Trump Who Calls Her Horseface While She Mocks His Penis

Federal judge S. James Otero has dismissed the lawsuit of porn star and stripper, Stormy Daniels, real name, Stephanie Clifford, which she filed against U.S. president Donald Trump. The lawsuit was filed by Daniels’ attorney, scandal plagued and frequently sued lawyer, Michael Avenatti. Judge Otero granted Trump’s Motion to Dismiss the defamation lawsuit.

Daniels sued Trump over a tweet on the social networking website Twitter, where he labeled her claim and sketch of a man she stated threatened her on the president’s orders “a total con job.” Trump tweeted “a sketch years later about a nonexistent man.” Daniels’ lawsuit labeled it defamation. The judge threw out the case agreeing with Trump’s lawyers that his statements on Twitter are covered by free speech.

Under Texas law Daniels had to prove it was a false statement, it defamed her and was done out of malice. Trump did slam Daniels out of malice regarding the derogatory things she stated about him. The loophole is Trump stated the man in the sketch Daniels alleged threatened her on Trump’s orders has not been found and it was not proven said person made these statements to her.

The judge also agreed with Trump stating “The Court agrees with Mr. Trump’s argument because the tweet in question constitutes ‘rhetorical hyperbole’ normally associated with politics and public discourse in the United States.” The judge also stated in his ruling, “A statement on matters of public concern must be provable as false before there can be liability for defamation.”

The ruling also stated, “Plaintiff does not allege facts establishing how Mr. Trump knew or did not know about the 2011 threat in the first place. Plaintiff must do this to sustain a cause of action for defamation.” The judge has awarded the president costs, which could amount to hundreds of thousands of dollars or more. Trump took to Twitter to slam Daniels losing the case and called her “horseface.”

Trump’s tweet stated, “’Federal Judge throws out Stormy Danials lawsuit versus Trump. Trump is entitled to full legal fees.’ @FoxNews Great, now I can go after Horseface and her 3rd rate lawyer in the Great State of Texas. She will confirm the letter she signed! She knows nothing about me, a total con!”

Stormy Daniels and husband Glendon Crain are in divorce court. He has won custody of their daughter and informed the court he is afraid she would sexually exploit the underage girl while on a stripper tour of U.S. cities

Daniels responded by claiming Trump is into bestiality, which is sex with animals. That’s a very serious accusation to make and one she can be sued for stating, even if it was a pun on his "horseface" statement. Daniels is also mocking the size of Trump’s penis. This she can’t reasonably be sued for as that is subjective, like him calling her “horseface.”
