Harvey Weinstein in handcuffs being perp walked by police in New York A number of executives in various areas of commerce have purchased lawsuit insurance. If they are sued and the cases are dismissed, they do not have to pay their legal fees. The insurance company pays the legal fees provided the executive did not act recklessly in conduct that provoked litigation. A number of people in Hollywood who engaged in questionable behavior, have bought this type of insurance. Lawsuit prone stars such as Usher and Madonna, are among them. Recently, the insurance company Usher took out a policy with refused to pay his legal fees, stating he acted recklessly in knowingly infecting people with gential herpes, who sued him. Disgraced former movie mogul, Harvey Weinstein had a policy with Steadfast Insurance Co., who issues policies for the Walt Disney Company. Weinstein's former film company, Miramax, was purchased by Disney in 1993 and Weinstein and his brother Bob remained employed with them until 2005. Weinstein filed for $1,000,000 in reimbursement from the Steadfast Insurance Co., regarding bail money, stemming from his arrest, indictment and arraignment this summer on rape charges. Steadfast Insurance Co. has refused and instead filed their own lawsuit against Weinstein, seeking a declarative judgment from the court, stating they do not have to pay him or anyone associated with him, for legal fees and associated costs incurred, due to his illegal behavior. Weinstein is pretending he does not know the point of this type of lawsuit insurance. They all have a clause making it expressly clear that policy holders are not to engage in reckless behavior that provokes legal action. Steadfast Insurance Co. is also seeking reimbursement of legal fees they paid at the beginning of the scandal, before realizing the accusations against Weinstein form a pattern of criminal behavior he engaged in against many women, who would also sue the discredited and disgraced movie producer. If convicted of all the rape charges, Weinstein faces the prospect of spending the rest of his life in prison.
